1. Objective and responsible body

This privacy policy explains to you the type, scope, and purpose of the processing of personal data, including its collection and use, within our online presence and the associated websites, functions, and contents (hereinafter jointly referred to as our “website”). This policy applies regardless of the domains, systems, platforms, or devices (e.g. desktop, mobile, etc.) on which the website is displayed or accessed.

The provider of this website and the controller of the data collected and processed is Nanovis GmbH, Länggstrasse 21, 8308 Illnau, Switzerland (hereinafter referred to as “we” or “the provider”). Please see the legal notice for this website to find out how to contact us.

The term “user” includes all customers and visitors to our website. [] []

2. Basic information on data processing

We process personal user data only in compliance with the relevant data protection regulations, taking into account the requirements to be as sparing as possible in the data we collect. This means that user data will only be processed if legal permission has been obtained. This will occur especially if the data is required to fulfill our contractual obligations, provide online services, prescribed by law, or if we have otherwise obtained consent.

We take organizational, contractual and technical security measures in accordance with the state of the art in order to ensure that the regulations of data protection laws are observed and thus to protect the data processed by us against accidental or intentional manipulation, loss, destruction or against access by unauthorized persons.

If content, tools, or other means are used from third parties headquartered abroad, we assume that the data will be transferred to those countries where they have their registered office. Data is transferred to third countries either on the basis of statutory permission, user consent, or special contractual clauses that guarantee the security of user data required by law.

3. Processing of personal data

In addition to the use expressly stated herein, the personal data will be processed for the following purposes on the basis of statutory permission or user consent:
– provision, execution, maintenance, optimization, and security of our services and user benefits;
– ensuring effective customer service and technical support.

We only transfer user data to third parties if necessary for billing purposes (e.g. to a payment service provider) or if necessary to fulfill our contractual obligations to the user (e.g. providing shipping addresses to vendors).

When users contact us via the contact form or by email, the information they provide is saved in order to process the inquiry and in the event there are any follow-up questions.
Personal data will be deleted once it has fulfilled its intended purpose and we are no longer obligated to store it.

4. Collection of access data

We collect data each time the server housing our site is accessed in the form of server log files. Access data includes the name of the requested website, file, date and time of access, amount of data transferred, report whether the site was successfully retrieved, browser type and version, the user’s operating system, the referrer URL (the site visited before coming to our site), the user’s IP address, and the requesting internet service provider.

We use this log data solely for statistical evaluations of our how our site is used so that we may optimize its operation and security. Such information is used according to statutory provisions without assigning it to users or profiling. However, we reserve the right also to examine log data if there is concrete evidence leading to reasonable suspicion of unlawful use.

5. Cookies & audience reach measurement

Cookies are information that is transferred from our web server or third party web servers to the user’s web browser and stored there for later retrieval. Users will be informed about the use of cookies in the context of pseudonymous audience reach measurement within the scope of this privacy policy.

It is possible to view this website without allowing cookies to be set. If users do not want cookies to be stored on their computer, they are asked to deactivate the corresponding option in the system settings of their browser. Cookies already saved can be deleted in the system settings of the browser at any time. Deactivating the use of cookies can restrict some of this site’s functionality.

It is possible to manage many online advertising cookies via the US website http://www.aboutads.info/choices or the European website http://www.youronlinechoices.com/uk/your-ad-choices/.

6. Google Analytics

We use Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google uses cookies. The information generated by the cookie about the user’s use of the website’s online offerings is generally transmitted to and stored on a Google server in the USA.

On our behalf, Google will use this information to evaluate the use of our online offering by the user, to compile reports on the activities within this online offering and to provide us with other services related to the use of this online offering and the internet. Pseudonymous usage profiles of users may be created from the processed data in this respect.

We use Google Analytics only with activated IP anonymization. This means that the IP address of the user is shortened by Google within the member states of the European Union or in other countries that are party to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address sent to a Google server in the US and shortened there.

The IP address sent by your browser will not be connected with other data from Google. Users may refuse the use of cookies by selecting the appropriate settings on their browser software. They can also prevent Google from collecting and processing the data generated by the cookie regarding their use of the site. This can be done by downloading and installing the browser plugin available via the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

More information on how Google uses data for advertising and how to control its use can be found on these Google websites: https://www.google.com/intl/de/policies/privacy/partners/ ( “How Google uses data when you use of sites or apps our partners”), http://www.google.com/policies/technologies/ads (“Use of data for advertising purposes”), http://www.google.de/settings/ads (“Administering information Google uses to display advertising”) and http://www.google.com/ads/preferences/ (“Decide which ads Google shows you”).

7. Google re-/marketing services

We use the marketing and re-marketing services (“Google Marketing Services” for short) of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, (“Google”).

The Google marketing services allow us to target ads for and on our site in order to present users only with ads that potentially match their interests. For example, if a user sees ads for products he has been interested in on other websites, this is referred to as “re-marketing”. When our website and other websites using Google marketing services are accessed, Google runs a code (web beacon) directly and (re)marketing tags are integrated into the website. These store a unique cookie or comparable technology on the user’s device. Cookies can be set by various domains, including google.com, doubleclick.net, invitemedia.com, admeld.com, googlesyndication.com or googleadservices.com. In this file it is noted which websites the user visits, which contents he is interested in and which offers he has clicked on, furthermore technical information about the browser and operating system, referring websites, visiting time as well as further information about the use of the online offer. The IP address of the users is also recorded, whereby we inform within the framework of Google Analytics that the IP address is shortened within member states of the European Union or in other signatory states of the European Economic Area Agreement and only in exceptional cases completely transmitted to a Google server in the USA and shortened there. The IP address is not combined with other data Google has about the user. The above information may also be linked by Google to such information from other sources. If users subsequently visit other websites, the ads displayed may be tailored to their interests.

User data is processed pseudonymously for Google marketing services. This means that Google does not store and process user names or email addresses, but instead processes the relevant data collected from the cookie with pseudonymous user profiles. This means that, from Google’s point of view, the ads are not managed and displayed for a specifically identified person, but for the cookie holder, regardless of who this cookie holder is. This does not apply if a user has expressly permitted Google to process the data without this pseudonymization. The information collected about users by DoubleClick is transmitted to Google and stored on Google’s servers in the USA.

One of the Google marketing services we use is Google AdWords, an online advertising platform. In the case of Google AdWords, each AdWords customer receives a different “conversion cookie”. Thus, cookies cannot be tracked using the website of Adwords customers. The information obtained using the conversion cookie is used to create conversion statistics for the Adwords advertisers who have opted for conversion tracking. Adwords customers can find out the total number of users who have clicked on their ad and been redirected to the page with a conversion tracking tag. However, advertisers do not obtain any information that can be used to identify users personally.

We integrate third-party advertisements on the basis of Google’s DoubleClick marketing service. DoubleClick uses cookies to enable Google and its partner sites to serve ads based on users’ visits to this or other websites.

We also include third-party advertisements based on the Google AdSense marketing service. AdSense uses cookies to enable Google and its partner sites to serve ads based on users’ visits to this site or other sites on the Internet.

Another Google marketing service we use is Google Tag Manager, which can be used to integrate other Google analytics and marketing services into our website (e.g. AdWords, DoubleClick, or Google Analytics).

Further information on Google’s use of data for marketing purposes can be found at: https://www.google.com/policies/technologies/ads, while Google’s privacy policy is available at https://www.google.com/policies/privacy.

If you wish to object to the collection of data by Google marketing services, you can use the setting and opt-out options provided by Google: http://www.google.com/ads/preferences.

8. Facebook social plug-ins

Our website uses social plugins ( “Plugins”) from the social network facebook.com, which is operated by Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”). The plugins are identifiable by a Facebook logo (white “f” on a blue tile, the terms “Like” or a “thumbs up” sign) or are marked with the phrase “Facebook Social Plugin”. The list and the appearance of Facebook social plugins can be viewed here:  https://developers.facebook.com/docs/plugins/.

When users access a part of our website that contains such a plug-in, their device establishes a direct connection to Facebook’s servers. The content of the plug-in is transmitted by Facebook directly to the user’s device and integrated into the online offer. Pseudonymous usage profiles of users may be created from the processed data in this respect. We therefore have no influence on the scope of the data which Facebook collects using this plugin and inform you according of our knowledge.

By including the plugin, Facebook receives the information that a user has accessed the corresponding page of the online offer. If you are logged into Facebook, Facebook can assign the visit to your Facebook account. If you interact with the plug-ins, for example, if you click the Like button or write a comment, the corresponding information is transmitted from your browser directly to Facebook and stored there. If you are not a member of Facebook, there is still the possibility that Facebook will receive your IP address and store it. According to Facebook, in Germany, only an anonymized IP address will be stored.

For the purpose and scope of data collection and further processing and use of data by Facebook, as well as the related rights and settings options to protect the privacy of users, please see Facebook’s privacy policy: https://www.facebook.com/about/privacy/.

If users belong to Facebook and do not want Facebook to collect data about their visit to this site and link it to their data stored on Facebook, they need to log out of Facebook before using our online offer and delete their cookies. Further settings and objections to the use of data for advertising purposes are possible within Facebook’s profile settings: https://www.facebook.com/settings?tab=ads or via the US page http://www.aboutads.info/choices/ or the EU page http://www.youronlinechoices.com/. The settings are cross-platform and are applied to all devices, such as desktop computers or mobile devices.

9. Facebook remarketing

Our website uses so-called “Facebook pixels” by the social network Facebook, which is operated by Facebook Inc, 1 Hacker Way, Menlo Park, CA 94025, USA, or, if you are based in the EU, Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”). Facebook pixels allow Facebook to identify those who visit our site as a target group for the presentation of Facebook ads. Accordingly, we use Facebook pixels to display Facebook ads we post only to Facebook users who have shown an interest in our website. This means that with the help of the Facebook pixel we want to make sure that our Facebook ads correspond to the potential interest of the users and are not annoying. The Facebook pixel also helps us understand the effectiveness of Facebook ads for statistical and marketing research purposes by showing and evaluating whether users are directed to our site after they have clicked a Facebook ad.

The Facebook pixel will be integrated directly by Facebook as soon as you visit our website and can store a so-called cookie, i.e. a small file, on your device. If you then log on to Facebook or visit Facebook in a registered state, your visiting our offer will be noted in your profile. The data collected on you remains anonymous to us, so it does not provide us with any information about the identity of the user. However, Facebook stores and processes the data so that a connection to the respective user profile is possible. Facebook processes the data in accordance with Facebook’s Data Usage Policy. Accordingly, you can find more information about how the remarketing pixels work and how Facebook ads are displayed in general in the Facebook Data Usage Policy: https://www.facebook.com/policy.php.

You can object to the collection and use of your data with Facebook pixels for Facebook ads. To do this, you can visit the page set up by Facebook and follow the instructions on usage-based advertising settings there: https://www.facebook.com/settings?tab=ads or file an objection at the US site http://www.aboutads.info/choices/ or the EU site http://www.youronlinechoices.com/. The settings are cross-platform and are applied to all devices, such as desktop computers or mobile devices.

10. Newsletter

The following notes are about our newsletter, its content and procedures regarding registration, distribution and statistical evaluation. They also explain your right to appeal. By subscribing to our newsletter, you agree to receive the newsletter and the related procedures for its distribution, etc.

Newsletter content We send newsletters, emails and other electronic notifications containing advertising information (hereinafter referred to as “newsletters”) only with the express consent of recipients or with statutory permission. If registration for the newsletter involves a specific description of its content, then this description is the basis on which users agree to receive newsletters. In addition, our newsletters contain information about our products, offers, promotions, and our company in general.

Double opt-in and logging: Registering for our newsletter takes place via a double opt-in procedure. This means that you will receive an email requesting confirmation of your subscription. The confirmation is required to ensure that no one else can subscribe using your email address. A record of subscriptions to the newsletter is kept to fulfil the legal requirements for recording the subscription process. The record contains the time of subscription and confirmation as well as the relevant IP address. Any changes to the data registered with the service provider sending the newsletter will also be recorded.

Provider sending the newsletter: The newsletter is sent by “X” (hereinafter referred to as the “service provider”). Its privacy policy can be viewed here: X.

The email addresses and other data belonging to our newsletter recipients as described herein will be stored on its servers. It will use this information to send our newsletter and analyze user interaction with it on our behalf. It can also use this data along with its own information to optimize or improve its services, e.g. to improve the sending and presentation of newsletters or for other business purposes by determining recipients’ countries of origin. However, it will not use said data to approach recipients directly nor do will it pass the information on to third parties.

Registration data: To subscribe to the newsletter, simply enter your email address.

Statistical data collection and analysis. The newsletters contain a web beacon, a pixel-sized file that is retrieved from the service provider’s server when the newsletter is opened. During the download, technical information such as your browser and operating system, as well as your IP address and the time of the download, are collected. This information is used for technical improvement of the service, as technical data or target group data can be analyzed according to their reading behavior, their download locations (identifiable through IP addresses) or download times. Statistical data collection also includes an analysis of when the newsletters are opened and which links are clicked upon. Although this information technically allows the tracking of individual newsletter recipients, we are not interested in watching the behavior of individual users. Data analysis is used to recognize patterns in the reading behavior of users, and to adapt contents accordingly or send different content according to the interests of our users.

Cancellation/Revocation. You can cancel your subscription to our newsletter at any time by revoking your consent to receive it. This will also revoke your consent to their being sent by the service provider and the statistical analyses they perform. A separate revocation of the dispatch by the dispatch service provider or the statistical evaluation is unfortunately not possible. You will find an unsubscribe link at the end of each newsletter.

11. Integration of third-party services and content

From time to time, third-party content such as maps or fonts from other websites may be integrated into this website. Users should assume that the third parties providing this content can see their IP addresses, since they would not be able to send the content to the users’ browsers without the IP address. The IP address is therefore necessary to display this content. These third parties can also set their own cookies and process user data for their own purposes. Pseudonymous usage profiles of users may be created from the processed data in this respect. We use this content in as sparing a manner as possible and select third-party providers which are reliable in the secure handling of data.

The following presentation offers an overview of third-party providers and their content in addition to links to their privacy policies which address how they process data and users’ options for opting out of the same:

– Google Maps, a service provided by Google Inc. 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Privacy Policy: https://www.google.com/policies/privacy/, Opt-Out: https://www.google.com/settings/ads/.

– YouTube videos, provided by Google Inc. 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Privacy Policy: https://www.google.com/policies/privacy/, Opt-Out: https://www.google.com/settings/ads/.

12. User rights and deletion of data

Users have the right to request free information about the personal data that we have stored about them.
In addition, users have the right to correct inaccurate data, revoke previously given consents, block and delete their personal data, and, in any suspected cases of unlawful data processing, file a complaint with the competent supervisory authority.

The data stored by us will be deleted as soon as it is no longer required for their intended use and there are no legal storage obligations to prevent deletion.

13. Changes to this privacy policy

We reserve the right to change this privacy policy in order to adapt it to changes in the law, the service, or the type and scope of data processing performed. However, this only applies with regard to declarations on data processing. If user consents are required or components of the privacy policy contain provisions relevant to any contractual relationship with users, changes will only be made with their consent.
Users are asked to inform themselves regularly about the contents of this policy.
